3. PRODUCTS AND CONTENT
3.1 All orders for products will be subject to availability. Accordingly, if any difficulty occurs with the supply of products or if items are out of stock, we will inform you immediately of the unavailability and refund any amount paid by you within 30 days.
3.2 All price information, product specifications, promotional actions, and services may be changed at any time.
4. USE OF OUR WEBSITE
By using our website and/or placing orders through it, the consumer undertakes to:
4.1. Use this website only for legally valid inquiries or orders.
4.2 Not to place any false or fraudulent orders. If we can reasonably consider that an order of this nature has been placed, we will be authorized to cancel it and inform the relevant authorities.
4.3 Provide us with your e-mail address, postal address, and/or other contact details truthfully and accurately. You also consent to the use of the information provided to contact you (if necessary, see our Privacy Policy). If you do not provide us with all the necessary information, we will not be able to process your order. By placing an order through this website, you declare that you are over 18 years old and have the legal capacity to enter a contract.
5. RESPONSIBILITIES OF VOLZ – SUPPLIER
5.1 All products marketed on our website are in accordance with Portuguese Law.
5.2 All information made available about the products and services is reliable and carefully elaborated. Nevertheless, we cannot be held responsible for damages or faults caused by the following:
5.2.1. loss or damage caused by consumer misuse.
5.2.2. failures in the online service that are caused by factors beyond our control, including any deficiencies or faults caused by the communications network or communications services provided by third parties, the computer system, modems, connection software or any computer viruses or arising from downloading via the service of files infected with or containing viruses or other properties that may affect the consumer’s equipment
5.2.3 Matching the consumer’s expectations, namely of materials or other product features.
5.2.4. interruptions of service due to uncontrollable and external issues.
6. RESPONSIBILITIES OF THE CONSUMER
6.1 Sharing correct information, namely personal data, contact details and address.
6.2 You may not use false information.
6.3 In the case of point 6.2, reserves the right to eliminate future purchases and cancel the supply of any other services made available.
7. ORDER CANCELLATION
7.1 At the consumer’s request:
7.1.1 The consumer may cancel the order if it has not yet been processed. The cancellation request must be made through the “Contacts” web page, with the choice of the topic “Exchanges and Returns”, or on the “Exchanges and Returns” page.
7.1.2 In case the cancellation request is made after the respective order has been processed, the order shall be returned according to the conditions set out in point 8.
7.2 By VOLZ’s decision:
7.2.1 VOLZ reserves the right not to process orders in case conditions are met to suspect the veracity of the information collected from the consumer.
7.2.2 VOLZ reserves the right not to process any order when there are errors in the values and/or characteristics of the products due to external technical problems.
8. EXCHANGES AND RETURNS
8.1 In accordance with Decree-Law No. 24/2014 of 14 February, about exchanges and returns of products purchased in the online shop, the consumer has 14 (fourteen) days after receipt of the order at the delivery address chosen by the same to request the respective exchange(s) or return(s).
8.2 The consumer must, within 14 (fourteen) days from the date of the communication of withdrawal, return the goods in a usable condition.
8.3 Prior to the return process, the consumer is obliged to fill in the form available on the website on the page “Contacts”, with the subject “Exchanges and Returns”, also present on the page “Exchanges and Returns”.
8.4 For an exchange or return to be successful, it is essential that the item is delivered in its perfect condition (unused, unwashed, odourless, or with any usage mark), in the same way, it was sold and accompanied by the respective invoice, labels, hygienic protector, cups, transport bag, thank you card, and other accessories incorporated in it.
8.5 The returns/exchanges will only be affected after verifying that the product is in perfect condition.
8.6 The packaging must be returned complete, as delivered, accompanied by the purchase invoice. The package and the indicated document should be sent to the following address:

8.7 The shipping costs associated with the return/exchange of any item will be the responsibility of the consumer.
8.8 Upon receipt of the returned product(s), and if the conditions described in points 8.1, 8.2 and 8.4 are met, the consumer will be refunded the amount corresponding to the amount paid for the product (purchase invoice value). If a promotional discount code has been used, the refund will only be for the amount actually paid, i.e., the total value of the item(s) less the respective discount. VOLZ reserves the right to deduct from the total amount of the refund, resulting from the return in question, the costs incurred as shipping costs of the respective order.
8.9 The method of refund depends on the payment method used for the respective order. In the case of credit or debit card payments, refunds will be credited to the cards used. In all other cases, proof of IBAN must be provided by the consumer and the refund will be made to the bank account indicated.
8.10. If any of the components of the item sold are missing or if the conditions listed in the previous points are not met, there will be no refund of the purchase price or shipping costs, and the product will be sent back to the original shipping address.
9. MANUFACTURING DEFECTS
9.1 If any article has a manufacturing defect that is not a result of harmful use, the consumer may claim it up to 2 (two) years after the date of purchase.
9.2 Before the return process, the consumer is obliged to fill in the form available on the site on the page “Contacts”, with the subject “Exchanges and Returns”, also present on the page “Exchanges and Returns”.
9.3 The resolution may be distinguished by the following forms: repair, exchange, discount on the price or return with a refund. The consumer may opt for one of them if it is possible and reasonable.
9.4 Whatever the solution is found, the consumer will not be charged any transport, labour, material, or other costs.
10. CONDITIONS AND SAFETY
10.1 The Consumer undertakes to observe and comply with all applicable legal provisions, in particular, not to practice or encourage the practice of illegal or offensive acts, such as sending indiscriminate unsolicited communications (“spamming”) in violation of the provisions of the applicable legislation on the processing of personal data and advertising communications and to observe the rules of use of the service, under penalty of VOLZ suspending or deactivating the service to the respective consumer.
10.2 The consumer expressly acknowledges and accepts that the IP Network is a public electronic communications network that can be used by several users and, as such, is subject to possible computer overloads, so that the provision of the service without interruptions, the non-loss of information or possible delays resulting from such overloads is not guaranteed.
10.3 In case of interruption of the provision of the service due to unforeseeable overload of the computer systems on which it is supported, VOLZ commits to regularise its operation as soon as possible.
11. SUSPENSION AND DEACTIVATION OF THE ONLINE SHOP SERVICE
11.1 Irrespective of any prior or subsequent communication, VOLZ reserves the right at any time and at its sole discretion to discontinue making the service and or part of the service available to any or all consumers.
11.2 Suspension or termination of the service shall not entitle the consumer or any third party to any damages or other compensation, and VOLZ shall not be liable for any consequences resulting from the suspension, cancellation, or termination of the service.
12. NOTICES
12.1 Without prejudice to other forms of communication set out in these Terms and Conditions, notifications made to the consumer relating to the service, including any amendments to these Terms and Conditions, may be made to the e-mail address previously provided by the consumer.
12.2 The consumer agrees to receive all communications and/or notifications related to the Online Shop at the address, contact telephone number, and/or electronic mail address (“e-mail”) indicated during the ordering or registration process in the Online Shop.
13. COMPLAINTS
13.1 The User may submit any complaint to the service, the mechanism, the rules, or available mediation, as well as to complain about acts or omissions that violate the legal provisions applicable to the acquisition of goods.
13.2 The complaint must be presented no later than 30 (thirty) days after the consumer recognizes the facts.
14. APPLICABLE LAW
The Contract is governed by Portuguese law.
